- Description: In the same week, the US regulator invited community banks to issue dollar stablecoins and Canada published its draft rules: full reserves, redemption in three business days, fees capped at 1% and no interest for holders. What each side decided and what it means for people who hold and spend USDT.

**Quick answer:** On 26 October 2026 the US Office of the Comptroller of the Currency (OCC) urged community banks to apply to issue payment stablecoins under the GENIUS Act, whose OCC rule takes effect on 18 January 2027\. Two days earlier, on 24 October, Canada published draft Stablecoin Regulations requiring 1:1 reserves at Canadian custodians, redemption within three business days, redemption fees capped at 1% and a ban on paying yield for holding, with comments open until about 23 December 2026 and the rules intended to apply from fall 2027.

**Key takeaways**

- **The US wants small banks in the game.** The OCC told community banks they can apply to issue dollar stablecoins directly or through a subsidiary, with supervision tailored to their size.
- **18 January 2027 is the US date.** From then, issuers under the OCC need its approval. Existing issuers with a substantially complete application can ask for a temporary waiver.
- **Canada's draft is strict on redemption.** One stablecoin must redeem for one unit of currency within three business days, with no minimum amount and a fee of at most 1%.
- **No yield for holding, in either country.** Both frameworks bar paying holders interest just for keeping the token. Canada also targets income-sharing through third parties, but still allows rewards for using a stablecoin.
- **Nothing changes today for a USDT holder.** These are rules for issuers and, in Canada, for payment service providers. Your self-custody wallet works as before.

Stablecoins are being written into the payment rulebook on both sides of the 49th parallel. Within 72 hours, the US banking regulator invited community banks to issue their own dollar tokens and Canada's Department of Finance published the draft regulations that will bring its Stablecoin Act into force. Here is what each side actually decided, checked against the primary documents, and what it means if you hold or spend stablecoins.

## What did the OCC tell community banks?

On 26 October 2026 the OCC said community banks should consider applying to become permitted payment stablecoin issuers under the GENIUS Act, either directly or through a subsidiary. It framed the call as part of its Community Bank Comeback agenda, which aims to tailor supervision so smaller banks can compete in payments.

- **The rule behind it:** the OCC's final GENIUS Act rule, announced in Bulletin 2026-51 on 21 October 2026, covers reserves, redemptions, risk management, capital, liquidity, reporting and supervision for issuers under its watch.
- **Start date:** issuers must comply from 18 January 2027, when prior OCC approval becomes required.
- **Waivers:** existing issuers that have a substantially complete application pending by that date can request a temporary waiver to keep operating during review, and the OCC said it generally expects to grant them where appropriate.
- **Not open yet:** as of 26 October 2026 the OCC was not yet accepting applications. The process opens once the required federal paperwork approval is done.
- **Still to come:** anti-money-laundering and sanctions requirements are being written separately with the Treasury Department.

Not every bank is cheering. The Independent Community Bankers of America sued the OCC on 2 October 2026 over national trust charters granted to crypto firms, and bank lobby groups have spent 2026 pushing to stop stablecoin rewards that could pull deposits away from banks.

## What is in Canada's draft Stablecoin Regulations?

Canada's Department of Finance published the draft Stablecoin Regulations in the Canada Gazette, Part I, on 24 October 2026\. They are needed to bring the Stablecoin Act, passed earlier in 2026, into force, and the government says it intends both to apply from fall 2027.

| Rule | What the draft says |
| -------------- | -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- |
| Who registers | Stablecoin issuers that are not banks register with the Bank of Canada, which also supervises them. The Minister of Finance can refuse or set conditions on national security grounds. |
| Reserves | At least equal to outstanding stablecoins at the end of every day, held at a Canadian-incorporated qualified custodian in segregated accounts. |
| Reserve assets | Cash and demand deposits, government debt with three months or less to run, one-day reverse repos backed by that debt, and money market funds holding only those assets. |
| Redemption | One-to-one, within three business days of the request, with no minimum amount. |
| Fees | Redemption fees capped at 1% of the amount redeemed, with seven days' public notice before any increase. |
| Yield | No interest or yield tied to holding a stablecoin, including through third parties. Rewards for using it are allowed. |
| Reporting | Monthly reports with an accountant's opinion on reserves, plus data on issuance and redemption by Canadians and the platforms used to sell to them. |
| Penalties | Up to C$1 million for serious violations and C$10 million for very serious ones. |
| Comments | Open for 60 days from publication, to about 23 December 2026. |

Two details matter beyond Canada's borders. The Act's idea of issuing covers stablecoins made available to Canadians wherever the issuer sits, though issuers under a substantially similar foreign framework can be recognised or exempted. And the Gazette estimates about 30 payment service providers, including custodial wallets and crypto payment processors, would newly come under Bank of Canada supervision.

## How do the US and Canadian approaches compare?

| | United States (GENIUS Act, OCC rule) | Canada (draft regulations) |
| ------------------- | -------------------------------------------------------------------------- | --------------------------------------------------------- |
| Status | Final rule, effective 18 January 2027 | Draft, comments to about 23 December 2026 |
| Regulator | OCC for issuers under its jurisdiction, other agencies still writing rules | Bank of Canada registers and supervises |
| Backing | Full reserves under the Act | Daily 1:1 reserves at a Canadian custodian |
| Redemption deadline | Set out in the rule's redemption standards | Three business days, fee capped at 1% |
| Yield for holders | Issuers barred from paying it | Barred for issuers and through third-party income sharing |

The headline difference is yield. In the US the ban sits on the issuer, which is why exchanges have been able to share reserve income with holders. Canada's draft goes after the funding arrangement itself, so that route is closed there, while rewards for spending survive.

## What does this mean if you hold or spend USDT?

As of October 2026, nothing changes in your wallet. Both frameworks regulate issuers, and in Canada the payment providers that handle stablecoins for customers. A token you hold in a self-custody wallet stays under your keys. What does change, slowly, is the world around it: more regulated banks issuing dollar tokens, clearer redemption promises, and payment providers that must report to a central bank.

- **Expect more bank-issued tokens.** If community banks follow the OCC's invitation, small US banks could issue their own dollar stablecoins from 2027.
- **Expect fewer pay-to-hold offers.** Both countries are closing the door on interest just for holding. Treat any such offer with extra care.
- **Spending is the use case regulators like.** Both frameworks allow rewards for using a stablecoin, which points the industry toward payments rather than parking money.

That last point is where Fizen sits. Fizen is building the stablecoin neobank for people on the move: a self-custody wallet you control, local QR payments, investing and travel data in one app. For visitors to Vietnam and the Philippines, Fizen QR Pay lets you pay a shop's local QR code with USDT: create or import your Fizen wallet, get USDT on Solana or BNB Chain into it, deposit from the wallet into QR Pay (KYC applies per wallet and per device), then scan and pay. Limits are US$800 per payment and US$1,000 per week, with no daily limit. Step-by-step help is in the [QR Pay guide](https://docs.fizen.io/help-center/fizen-qr-pay/getting-started?ref=blog.fizen.io). Fizen QR Pay is not available in the US or Canada, and these rules do not change that.

## Frequently asked questions

#### When do the US stablecoin rules take effect?

The OCC's GENIUS Act rule takes effect on 18 January 2027, when issuers under the OCC need its prior approval. Existing issuers with a substantially complete application by then can ask for a temporary waiver.

#### Can a community bank issue a stablecoin?

Yes. On 26 October 2026 the OCC said community banks can apply to become permitted payment stablecoin issuers directly or through a subsidiary, but applications had not opened yet.

#### What are Canada's proposed stablecoin rules?

Canada's draft, published on 24 October 2026, requires daily 1:1 reserves at a Canadian custodian, redemption within three business days, fees capped at 1%, monthly audited reports and no yield for holding.

#### When will Canada's stablecoin rules apply?

Comments close about 23 December 2026, and the government intends the regulations and the Stablecoin Act to come into force in fall 2027.

#### Do these rules affect USDT in my own wallet?

No. They regulate issuers and, in Canada, payment service providers. A stablecoin in a self-custody wallet stays under your control.
